The essentials

  • Browse freely. Contact us by email, phone or our linked booking calendar.
  • Share only the details needed to discuss or deliver your project.
  • Your accepted quote or written project agreement sets the commercial terms for your order.

Privacy policy

This policy describes how Kick Ass Swag (“we,” “us” or “our”), a Las Vegas-based branded merchandise business, handles personal information in connection with kickassswag.com, enquiries, consultations and related customer services. It also explains how to contact us about your information.

1. Information you choose to share

When you email, call, book a meeting or work with us, we may receive your name, business name, role, email address, phone number, messages and meeting details. For a project, this may also include artwork, quantities, budget, delivery dates, billing details, shipping addresses and recipient information needed for fulfillment.

Our website does not require a visitor account or provide an onsite shopping checkout. Please do not send payment-card numbers, passwords, government identification or other sensitive personal information in an ordinary email. If you provide information about colleagues or recipients, make sure you are authorized to do so and that they receive any required privacy information.

2. Information received when you visit

Our hosting and security providers may process technical information such as your IP address, browser and device details, requested pages, referring page, timestamps and error or security logs. This supports delivery of the website, troubleshooting and protection against misuse. Embedded media and websites you choose to open may collect additional information as described below.

3. How we use information

  • Answer enquiries, arrange consultations and communicate about your requests.
  • Prepare quotes, discuss artwork and product options, and manage approved projects.
  • Coordinate production, billing, delivery, kitting and fulfillment where relevant.
  • Maintain business records, resolve issues and meet applicable legal obligations.
  • Keep our website and communications working and protect against fraud or misuse.

Where we send promotional communications, you can ask us to stop or use an unsubscribe option provided in the message. This does not prevent necessary messages about an active enquiry, order or legal matter.

4. When information is shared

Information may be shared with people and service providers who need it for the purposes above: our authorized team; hosting, security, email, scheduling and business-software providers; relevant production, decoration, packaging and fulfillment partners; delivery carriers; and professional advisers. We aim to provide the information needed for their role, such as a delivery address to a carrier or approved artwork to a production partner.

We may also disclose information when required by law, to respond to a valid legal request, to protect rights or safety, or in connection with a business transfer subject to applicable privacy protections. We do not sell the contact or project information you provide to us for money.

Cookies & third-party services

Cookies and similar technologies can support security, video playback and other provider features. Your browser can block or remove cookies; doing so may affect some functionality.

  • Website hosting — Vercel. Vercel delivers and protects this site and may process technical request information. Vercel privacy notice ↗
  • Video — Vimeo. Our welcome video is embedded from Vimeo with its Do Not Track setting enabled. This limits player analytics but does not prevent all processing: essential security cookies may still be used, and a browser may send existing Vimeo cookies. Loading the page containing the player connects your browser to Vimeo. Vimeo privacy information ↗
  • Meeting bookings — Calendly. Our booking button opens Calendly. Information you enter there is processed to arrange your meeting and may be shared with us and relevant calendar services. Calendly privacy notice ↗
  • External catalog, social and review links. Links to our product catalog, social profiles, Google and Yelp open third-party services. Their own notices and terms govern what happens on those services. Review screenshots displayed on our site are hosted images, rather than embedded review widgets.

Third-party services may receive information about your interactions over time and across other websites, particularly if you are signed in to their services or have existing cookies. We do not control their independent processing. Our website does not itself use cross-site behavioral-advertising tracking; browser Do Not Track signals do not change the site's own functionality. Vimeo's player setting is separate from your browser's signal.

Your privacy choices

5. Access, correction, deletion & other requests

Email Hi@kickassswag.com with the subject “Privacy request” to ask about information we hold, request access or correction, request deletion, or exercise another right available under applicable law. Depending on your location and the law that applies, rights may include a copy of your information, portability, objection or restriction, withdrawal of consent, and an opt-out of certain uses or disclosures.

Tell us the nature of your request and enough context to locate the relevant records. We may need proportionate information to verify your identity or an authorized agent's authority. Do not email sensitive identity documents unless we have arranged an appropriate way to verify you. Some records may need to be retained for legal obligations, active transactions, security or the protection of legal rights. We will explain relevant limitations and respond within applicable time limits. You may contact us to ask for reconsideration and may complain to the relevant privacy regulator where that right applies. We will not unlawfully discriminate against you for exercising a privacy right.

6. Nevada requests

Nevada residents may submit a verified request directing us not to sell covered information by emailing Hi@kickassswag.com, our designated request address. We do not sell contact or project information for money, but you may still submit this request. Where Nevada's operator opt-out requirements apply, we respond within 60 days; if a reasonably necessary extension of up to 30 days is permitted, we notify you.

7. Retention, security & international processing

We retain information for as long as reasonably needed for the purposes in this policy, including the relevant customer relationship, project administration, accounting, legal obligations and resolving disputes. The period varies with the information and circumstances. You can contact us about deletion or retention of a particular record.

We use reasonable safeguards appropriate to the information and our activities, but no website, email system or transmission can be guaranteed completely secure. Our business is based in the United States, and providers or project partners may process information in the United States or other countries. Applicable privacy protections can differ between countries; legal requirements governing a particular transfer still apply.

Where a law requires a legal basis for processing, the basis depends on the activity: responding to a request or performing a contract, complying with a legal obligation, legitimate business interests where permitted and balanced against your rights, or consent where required. A general statement in this policy does not replace consent where the law requires it.

8. Children & policy updates

This website is intended for business customers and people planning merchandise projects, not children under 13. We do not knowingly seek personal information from children under 13. If you believe a child has provided personal information, contact us so we can investigate and take appropriate action.

We update this page when our practices or requirements change and revise the date at the top. For material changes, we will provide a prominent notice on the website or contact affected people where appropriate or required. Changes do not remove rights that apply to information already collected.

Website & project terms

1. Scope & using this website

These terms govern use of the Kick Ass Swag website. Our site introduces our business, shares merchandise ideas and helps you contact us. If you do not agree to these website terms, please stop using the site. To enter a commercial agreement, you must have legal capacity and authority to act for yourself or the organization you represent.

For an actual project, the quote, order confirmation, invoice terms or separate written agreement that you and Kick Ass Swag accept governs the specific transaction. Where those agreed commercial terms conflict with these general website terms, the agreed project terms take priority, subject to applicable law.

2. Product ideas, availability & website information

Images, examples, dimensions, colors and product information on this site are provided to help you explore ideas. Some category images are merchandise concepts; they are not a guarantee of a completed client project or of an item's availability. Logos and third-party trademarks belong to their respective owners, and their appearance does not imply that every displayed organization endorses every product or statement.

Products, materials, decoration options, minimum quantities, pricing and availability can change. Confirm the details in your project quote. We aim to keep website information accurate, but errors or outdated information can occur. Contact us before relying on a detail that is important to your order.

Custom orders & approvals

3. Quotes, acceptance & payment

Browsing, requesting information or booking a consultation does not by itself place an order. Before production, the parties need to agree the relevant scope, products, quantities, artwork, price, payment terms and delivery requirements. Quote validity, taxes, freight and any additional charges should be stated in the applicable quote or confirmation. We do not publish a universal deposit, credit or payment schedule on this page.

4. Artwork, proofs & permissions

You are responsible for having permission to use artwork, logos, fonts, photographs and other material you provide. You retain your rights in that material and give us and the relevant project partners limited permission to use, reproduce or adapt it as needed to evaluate and deliver your requested project.

Review proofs and specifications carefully, including spelling, colors, placement, sizing, quantities and delivery details. Confirm approval in the manner agreed for your order. Changes after approval may affect price and timing and need written confirmation. Screen displays, materials and production methods can affect appearance; agree any essential tolerances or samples before production.

Providing artwork for a project does not automatically authorize us to publish your brand or project as a case study or client example. Separate permission is needed for that use.

5. Production, delivery & recipient details

Production and shipping times depend on the selected products, approvals, payment arrangements and supplier or carrier conditions. Website timing examples are estimates; any deadline or guarantee must be expressly confirmed for your project. Tell us about a fixed event date before placing an order.

You are responsible for providing accurate and authorized delivery and recipient information. Changes, missed delivery attempts, customs requirements or events outside either party's reasonable control may affect delivery. Responsibility for freight, customs, taxes, delivery risk and any remedies is determined by your agreed order terms and applicable law.

6. Changes, cancellations, returns & concerns

Because merchandise may be personalized or produced to order, a change or cancellation may involve work already performed or commitments already made. The applicable cancellation, return, refund, defect and warranty terms must be established in your accepted quote or written project agreement and remain subject to applicable law.

If an order arrives damaged, appears defective or differs from what was agreed, contact us promptly with the order details and photographs where helpful. Keep the affected items and packaging while we discuss the issue. This request does not replace any legal right or applicable reporting period.

Website use & general provisions

7. Content ownership & acceptable use

Website copy, design and other original materials are owned by Kick Ass Swag or used with permission. You may view and share links for legitimate personal or business purposes. Other uses require permission unless applicable law allows them. Do not copy third-party logos or artwork from this site for use on your own merchandise without the rights holder's permission.

Do not use the website for unlawful activity, submit material you have no right to use, impersonate others, attempt unauthorized access, distribute malicious code or interfere with the site's operation. Normal search-engine indexing and lawful linking are permitted.

8. External services & availability

External catalogs, booking tools, video platforms and other linked services have their own terms and privacy practices. We do not control their independent content, availability or policies. Our website may be updated, interrupted or temporarily unavailable; it is not a promise of uninterrupted access.

9. Responsibility & your legal rights

Website content is general information, not an independent product warranty or a substitute for agreed project specifications. To the extent permitted by law, we are not responsible for indirect or consequential losses arising solely from use of, or inability to use, this informational website. Any responsibility connected with an actual order is governed by the accepted project agreement and applicable law.

Nothing on this page excludes liability that cannot lawfully be excluded, excuses fraud or willful misconduct, or takes away mandatory consumer or privacy rights. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.

10. Resolving issues, applicable law & changes

Please contact us first so we can try to resolve an issue directly. Subject to any different valid written project agreement and mandatory law, these website terms are governed by Nevada law. Any court proceedings are subject to the jurisdiction rules that legally apply; these terms do not require arbitration or waive non-waivable rights.

We may update these website terms by publishing a revised version and updating the date above. New website terms do not retroactively change an already accepted project's commercial terms without the agreement or legal basis required for that change.
